The bill defines innovative agricultural technology project as an agricultural technology or system placed in service before December 31, 2035, and for which the primary purpose is to produce, store, process, and package specialty crops using precision agriculture or controlled environment agriculture.

CEA is poised for growth. The U.S., the largest CEA producer in the world is CEA is well positioned for additional growth. CEA producers are already penetrating local food retailer markets nationwide and there is rapid growth in the Agtech sector. A confluence of new factors, however, have emerged in early 2025, driving CEA adoption and development to greater levels. U.S. population’s awareness in the food-health nexus has reached a critical mass demanding abundant and accessible toxic-free, nutritious, and sustainably grown food.
A flurry of new regulation in 2025. Subsequent federal and state political will is being markedly forged to bolster food-health policy and systematic reforms, with a current focus on chronic disease prevention, particularly in children. A flurry of bills have been unleashed recently by numerous individual states supporting various regulations including elimination or reduction of toxins in food and water, to SNAP reform, to providing incentives for CEA development and more. In addition, the U.S. Congress has several related bills currently pending, including H.B.1705, the Supporting Innovation in Agriculture Act of 2025.
